1. Scope and Contracting Party

1.1 These Terms & Conditions apply to the use of the online product “AIQ – AI Readiness Assessment” (hereinafter “AIQ”), available at cindr.la/aiq.

1.2 The provider and contracting party is:

(hereinafter “Provider” or “we”)

1.3 These Terms & Conditions apply to both consumers and businesses.

1.4 Conflicting or deviating terms of the customer do not become part of the contract.


2. Description of Services

2.1 AIQ is a web-based self-assessment tool for analysing the AI maturity of organisations and professionals.

2.2 Free Basic Report
After entering a valid e-mail address and submitting the questionnaire, the user receives a compact basic report by e-mail.

2.3 Paid Strategic Report
After successful payment, the user receives a personalised Strategic Report (PDF, approx. 5 pages), which includes:

  • detailed evaluation across multiple assessment dimensions
  • AI-generated action recommendations
  • prioritised list of measures
  • optional personalisation

2.4 AI-Generated Content
Parts of the report are generated by large language models. The primary provider is Mistral AI (EU); Anthropic Claude (USA) is used as a fallback system.

The content does not constitute legal, tax, or business advice and does not replace individual professional consultation.
The provider assumes no liability for decisions made on the basis of this content.

2.5 Further Development
The provider reserves the right to further develop the scope of services, provided the essential characteristics of the paid product are not impaired.


3. Conclusion of Contract

3.1 Free Access
The contract for free use is concluded by submitting the questionnaire.

3.2 Paid Report
The contract is concluded by:

  • selecting the Strategic Report
  • entering payment details
  • completing the payment via Stripe
  • payment confirmation

3.3 The contract text is not separately stored. The essential information is communicated by e-mail.


4. Prices and Payment

4.1 The price for the Strategic Report is EUR 290.00.

4.2 All prices include the applicable statutory VAT.

4.3 Payment is processed via Stripe Payments Europe Ltd.

4.4 Payment is due immediately.


5. Right of Withdrawal

5.1 Consumers generally have a 14-day right of withdrawal.

5.2 Exclusion of the Right of Withdrawal for Digital Content
Pursuant to § 18 (1) no. 11 FAGG (Austrian Distance Selling Act), the right of withdrawal expires for contracts concerning digital content not supplied on a tangible medium if:

  • the provider has begun performance
  • the user has given express consent
  • the user has acknowledged the loss of the right of withdrawal

By completing the purchase, the user expressly declares:

“I agree that the creation and delivery of my Strategic Report begins before the expiry of the withdrawal period and that I thereby lose my right of withdrawal.”

This consent is given actively before completing the payment (e.g. by ticking a corresponding checkbox).


6. Delivery and Provision

6.1 The Strategic Report is generated automatically after payment and delivered by e-mail.

6.2 Delivery typically occurs within a few minutes.

6.3 Delays caused by third-party providers cannot be excluded.

6.4 There is no entitlement to immediate delivery, particularly in the event of technical disruptions or delays caused by third-party providers.


7. Usage Rights

7.1 The user receives a non-exclusive, non-transferable right of use for internal purposes.

7.2 Redistribution or commercial use without consent is not permitted.

7.3 The report contains AI-generated content. All rights to the report structure, design, and non-personalised content remain with the provider.


8. Liability

8.1 The provider bears unlimited liability for damages arising from injury to life, body, or health, as well as for damages caused by intent or gross negligence.

8.2 For damages caused by slight negligence, the provider is only liable in the event of a breach of material contractual obligations (cardinal obligations), limited to the foreseeable, contract-typical damage at the time of conclusion of the contract.

8.3 The provider is not liable for:

  • the accuracy, completeness, and timeliness of data entered by the user
  • decisions made on the basis of the report
  • outages or disruptions caused by third-party providers (payment service providers, cloud infrastructure, e-mail providers)

8.4 Warranty
Warranty claims for digital services are governed by the provisions of the Austrian Civil Code (ABGB) and the Consumer Protection Act (KSchG). In the event of justified defects in the report (e.g. faulty generation, failure to deliver), the provider will, at its discretion, provide subsequent performance or refund the purchase price.


9. Data Protection

The processing of personal data is carried out in accordance with the privacy policy at cindr.la/aiq/datenschutz.


10. Final Provisions

10.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

10.2 The place of jurisdiction is Vienna, to the extent permitted by law.

10.4 Should individual provisions be invalid, the validity of the remaining provisions shall not be affected.
